Ted Cruz, Josh Hawley, and Mike Lee Ask the Supreme Court to Overturn Roe v. Wade

Three conservative Senate Republicans submitted a brief urging the Supreme Court to overturn landmark judgments protecting women’s right to abortion.

The 33-page brief was signed by Texas Sen, Ted Cruz, Utah’s Senator Mike Lee, and Missouri’s Sen. Josh Hawley. The conservative lawmakers petitioned the court to review the case next term as a vehicle to vehicle to overturn Roe v. Wade and related rulings. According to the senators, the status quo was “untenable,” and the legal doctrine on abortion that emerged over roughly the past five decades since Roe was decided in 1973 has given judges excessive discretion and proven unworkable.

“Where a legal doctrine has repeatedly failed to offer clarity — where it has proved unworkable in the past and will likely engender unpredictable consequences in the future — its existence constitutes an open invitation to judges to interpret it according to their own policy preferences, usurping the constitutional prerogatives of the legislature,” the brief reads.

Anti-abortion groups are hoping the Supreme Court to move forward with the matter, considering the bench is now composed of six conservative justices — three of them appointed by Trump.
