Abbott to Challenge SCOTUS on Education of Immigrants

Gov. Greg Abbott stated in the Joe Pags show that he considers the public education of immigrant children implies a great economic burden on the state of Texas. Due to this, he might seek to resurrect a Supreme Court case with the state called Plyler v. Doe from 1982 to reestablish funding and remove aid for immigrant children who attend public schools.

The state of Texas suing of the federal government in the 1982 case was revoked at the time, with the Primary Holding stating “A state cannot prevent children of undocumented immigrants from attending public school unless a substantial state interest is involved”. During Pagliarulo’s conservative radio show, Abbott stated, “I think we will resurrect that case and challenge this issue again, because the expenses are extraordinary and the times are different than when Plyler versus Doe was issued many decades ago.”

According to the U.S. Customs and Borders Statistics, around 165,894 border encounters were registered in February, and 221,303 encounters in March, the month with the most encounters in all of Biden’s administration according to the Austin-American Statesman. According to the American Immigration Council, 1 in 6 Texan residents is an immigrant, and another 1 in 6 Texas residents born in the state have an immigrant family member. 
Abbott has been critical of the current federal government actions regarding immigration, with controversial actions like planning to bus immigrants to Washington D.C. in early May, in protest to Biden’s plan to stop Tile 42’s deportations in May. In general, his administration has been characterized for catering to conservatives who see immigrant populations as a threat.
